These Terms of Service ("Terms") govern your use of the Emotiva mobile application and website (the "Service"). By creating an account, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

You must be at least 13 years old to use Emotiva. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.

You are responsible for keeping your account credentials secure and for all activity under your account. You agree to provide accurate information when registering and to keep it up to date.

By using Emotiva, you grant Piqos LLC permission to collect, store, process, and analyze your data — including mood entries, goals, usage patterns, device information, location data, and other personal information — for the following purposes:

• Providing and maintaining the Emotiva service
• Generating insights, trends, and analytics from user data
• Improving our products and developing new features
• Serving relevant advertisements to free-tier users
• Any other purpose we reasonably determine to be related to operating and improving the service

Emotiva uses third-party services including Google Analytics, Microsoft Clarity, and Google AdMob. These services may collect session data, device identifiers, and behavioral information.

Free-tier users will see advertisements served by Google AdMob. Ad-related data may be collected and used to deliver relevant ads based on your interests and usage.

You agree not to:

• Violate any applicable laws or regulations
• Attempt to access other users' data or gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use the Service for any commercial purpose without our written permission
• Upload or transmit harmful, offensive, or illegal content

All content, design, code, and trademarks within Emotiva are owned by or licensed to Piqos LLC. You may not copy, reproduce, distribute, or create derivative works without our written permission.

The data you create (mood entries, notes, goals) remains yours. By using the Service, you grant us a license to store, process, and analyze your data as described in these Terms and our Privacy Policy.

You may delete your account at any time from the app settings. Deletion will permanently remove your personally identifiable data from our servers. Anonymized or aggregated data that is not linked to your identity may be retained.

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by law, Piqos LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

We may update these Terms from time to time. When we make significant changes, we will notify you through the app or other reasonable means. Continued use of Emotiva after changes are posted constitutes your acceptance of the updated Terms.

These Terms are governed by the laws of the state of Utah, without regard to conflict of law principles.

Emotiva is operated by Piqos LLC, registered in the state of Utah.
